Terms of Service

These Terms of Service ("Terms") govern your access to and use of BakeryOS, a bakery management software platform operated from India. By creating an account or using BakeryOS, you confirm that you have read, understood, and agree to be bound by these Terms.

If you are using BakeryOS on behalf of a business, you represent that you have the authority to bind that business to these Terms.

1 Service scope

BakeryOS provides cloud-based software tools designed for bakery business management, including but not limited to:

  • Order intake, queueing, and production management
  • Ingredient-level inventory tracking and low-stock alerts
  • GST-compliant billing and invoice generation
  • Customer records, order history, and repeat purchase tracking
  • Daily sales analytics, margin reporting, and time-slot demand visibility
  • Advance booking and slot-based production planning

We may add, modify, or remove features over time. Where changes materially affect your workflow, we will communicate them in advance through your registered email or in-app notification.

2 Eligibility & account responsibility

BakeryOS is intended for bakery business owners, operators, and their authorised staff in India. By creating an account you confirm that:

  • You are at least 18 years of age.
  • The business information you provide is accurate and kept up to date.
  • You are responsible for maintaining the confidentiality of your login credentials and for restricting access to your account.
  • You are responsible for all activity that occurs under your account, whether performed by you or by staff you have granted access to.
Account security

If you suspect unauthorised access to your account, change your password immediately and contact support@inkurban.in. We cannot be held responsible for losses arising from credentials shared with or compromised by third parties.

3 Acceptable use

You agree to use BakeryOS only for its intended purpose of bakery business management. You must not:

  • Attempt to gain unauthorised access to any part of the platform, its servers, or connected systems.
  • Upload or transmit malicious code, spam, or content that violates applicable Indian law.
  • Use automated tools, scripts, or bots to scrape or extract data from the platform without written permission.
  • Resell, sublicense, or share your account access with persons outside your registered bakery business.
  • Interfere with the stability, performance, or security of BakeryOS for other users.
  • Use the platform to process transactions or data unrelated to your bakery business operations.
Violations

Breaches of acceptable use may result in immediate account suspension without refund. Serious violations including attempted security breaches will be reported to relevant Indian regulatory and law enforcement authorities.

4 Billing & renewals

Paid BakeryOS plans are billed in advance — monthly or annually — in Indian Rupees (INR) inclusive of applicable GST. The plan amount and next billing date are always visible in your account under Account → Billing.

  • Auto-renewal — subscriptions renew automatically on the billing date. You will receive a reminder email 7 days before each renewal.
  • Plan changes — upgrades take effect immediately and are billed pro-rata. Downgrades take effect at the next billing cycle.
  • Failed payments — if a payment fails, we will retry once after 3 days. After a second failure, your account will be moved to a limited-access state until payment is resolved.
  • Refunds — refund eligibility is governed by our Refund Policy, which forms part of these Terms.
GST invoices

A GST-compliant tax invoice is generated automatically for every payment and available for download from Account → Billing → Invoice history. If you need a revised invoice for any reason, contact support@inkurban.in.

5 Service availability

We target high availability for BakeryOS and monitor the platform continuously. However, we do not guarantee uninterrupted or error-free service. Downtime may result from:

  • Scheduled maintenance — communicated at least 24 hours in advance.
  • Unplanned infrastructure or third-party service failures.
  • Force majeure events beyond our reasonable control.

Where a verified outage exceeds 72 consecutive hours, affected subscribers may be eligible for a pro-rated credit at our discretion. See our Refund Policy for details.

6 Intellectual property

All BakeryOS software, code, user interface design, brand assets, documentation, and associated materials are the exclusive property of BakeryOS and are protected under applicable Indian intellectual property law.

Your subscription grants you a limited, non-exclusive, non-transferable licence to use the platform for your bakery business operations during the active subscription period. This licence does not transfer ownership of any BakeryOS intellectual property to you.

Your data remains yours. BakeryOS does not claim ownership over the business data you enter — your orders, customers, products, and inventory records. We process this data solely to provide the service to you.

7 Data & backups

BakeryOS maintains regular automated backups of platform data. However, you are responsible for maintaining your own operational data records where required by law or for your business continuity needs. We recommend exporting key reports periodically.

  • Data retention on cancellation — your data is retained for 30 days after subscription cancellation. You can export it at any time during this window via Account → Export data.
  • Data deletion — after the 30-day retention period, data is deleted from our systems. This action is not reversible.
  • Privacy — how we collect, process, and protect your personal and business data is detailed in our Privacy Policy.

8 Termination

By you — you may stop using BakeryOS and cancel your subscription at any time from your account settings. Cancellation instructions are detailed in our Refund Policy.

By BakeryOS — we reserve the right to suspend or permanently terminate your account without prior notice in cases of:

  • Material violation of these Terms, including acceptable use violations.
  • Fraudulent payment activity or repeated failed payments.
  • Any activity that poses a security risk to the platform or other users.
  • Court order, regulatory direction, or legal obligation requiring us to do so.

Where termination is not due to your fault, we will provide reasonable notice and a pro-rated refund for unused subscription time where applicable.

9 Limitation of liability

To the maximum extent permitted under applicable Indian law, BakeryOS's total cumulative liability to you for any claim arising from use of the service shall not exceed the subscription amount you paid in the three months preceding the claim.

BakeryOS is not liable for any indirect, incidental, special, or consequential damages including but not limited to loss of business revenue, loss of data, or loss of goodwill arising from your use of or inability to use the service — even if we have been advised of the possibility of such damages.

Important

BakeryOS is a management tool that assists your operations. It does not replace your obligation to maintain independent records, comply with food safety regulations, or meet any other legal requirement applicable to your bakery business under Indian law.

10 Governing law

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of India.

We encourage resolving any disputes first by contacting our support team at support@inkurban.in before initiating formal legal proceedings — most issues can be resolved quickly at this stage.

11 Changes to terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business operations. When we make material changes, we will:

  • Email all active subscribers at least 14 days before the changes take effect.
  • Display a notice in your BakeryOS dashboard during the notice period.
  • Update the effective date at the top of this page.

Continued use of BakeryOS after the effective date of updated Terms constitutes your acceptance of those changes. If you do not agree to updated Terms, you may cancel your subscription before the effective date.
